Maintaining compliance with regulatory requirements is one of the major obstacles that Investment Managers, Brokers and Financial Advisors are facing before jumping into social media. If you haven’t heard your Legal & Compliance department say they don’t have the people necessary to monitor all of the firm’s social media, then consider yourself lucky!
On the other hand, if your firm is struggling with determining how they can go about applying regulations such as FINRA’s 10-06 notice for social media, there might just be some third party technology solutions that can help.
One of the main objectives of FINRA’s 10-06 notice requires firms to effectively and appropriately supervise their representatives’ social media use. The regulatory notice is very clear that every firm is required to retain communications made through social media sites. Additionally, at the time FINRA’s notice was published in January 2010, FINRA even mentioned being aware of some technology providers that offer solutions to deal with large variety of social media compliance challenges such as:

As an industry, we are lucky that none of the technology tools needed to be in regulatory compliance have to be custom-built in house. Instead we can now turn to a variety of third party technology providers. The key solution providers are summarized below:
Stop by the sites listed above and let me know what you think of their solutions.

Great summary of what’s available, Adam, and thanks for including Smarsh. I wanted to mention the availability of the Smarsh Companion Guide to SEC/FINRA Social Networking Compliance. It’s a very handy document that includes details on all the regulations that are relevant to you and your business. Download it at http://www.Smarsh.com/CompanionGuide.
And if anybody is interested in checking out a demo to see how Smarsh’s end-to-end solution works, just give us a call or drop us an email.
Blane,
Thanks for checking in. It is really good to see that as an industry, we have some 3rd party solutions to choose from. It makes the discussion with Legal and Compliance so much easier to be able to point to tangible products that they can evaluate.
Adam @ Smarsh,
My pleasure to provide the summary as it is something that I think will help those who are trying to figure out how to make Legal & Compliance happy and do so in a timely manner from an IT standpoint. I am sure people would be interested to hear more about your integration with Socialware. Can you let us know about that?
Thanks!
Nice work Adam. I thought I’d add a note about Arkovi’s management and workflow capabilities. At Triplestop, we’ve chosen Arkovi as a partner in developing our social business solutions precisely because they get it. Arkovi works closely with each of their clients to develop the specific workflow’s and tools in response to their clients needs. The best solutions are integrated into Arklovi’s offerings.
Like us, Arkovi’s team spent years in the trenches in the financial services industry and understands what it takes to get things done in that environment. For a quick take on how we approach social business for financial services, take a look at our FINRA Social Cheat Sheet found at http://www.triplestopllc.com/2010/03/18/finra-rules-on-social-media/

Mike,
Thanks for noting Triplestop’s relationship with Arkovi. Can you share with the readers some enhancements Triplestop would like to see out of Arkovi’s solution or other social media compliance solutions?
Additionally, your 1 page summary is a terrific resource! Nicely done.
As a firm helping financial advisors with smart social media and blogging strategies, we are thrilled about the simple to implement solutions for archiving online activity. We are also grateful for the opportunity to work closely with Arkovi. Thanks for the great article Adam!

Hello Stephanie,
From working with FAs, where do you see the line drawn between requiring a full-scale enterprise solution like Socialware and a simpler, Arkovi based solution?
Thanks for the comment and visiting!

Keyword search and flagging will be a great next offering from the technology providers. That is, having the ability to set keywords or phrases that alert a sender that their posting *may* be out of guidelines–perhaps even being able to send a real-time alert to compliance staff. The point is that I think many firms hesitate on social media not only because of its newness, but because they’re worried about what gets out their that they can’t “take back.” Having some sort of ability to keep the wrong content from going out in the first place will go a long way towards building confidence and usage. This assumes, of course, that firms don’t focus so much on prevention that they kill off the benefits of using social media tools in the first place.
Adam,
Glad you like our cheat sheet.
All of us in this space can name a few things, like mobile access, that are on everyone’s list of essentials. Although we can’t share specifics on enhancements, we can say that Arkovi’s roadmap is almost exactly what we wanted to see from a partner, and jibes with what we’re hearing from asset managers. And Arkovi is flexible about adapting to market needs. They’re the kind of partner we’d have wanted to work with when we were on the client side.

Mobile could be quite challenging since the companies don’t own a lot of the mobile devices employees use beyond a Blackberry which a lot of times is “locked down”. It will be great to see how some of the solution providers try to tackle it.
Hi Adam
We’ve just added the capability for the FaceTime solution to be delivered as a SaaS hosted solution – so covering those remote and home users, now as well as those on the corporate lan. And if organizations don’t want their data in the cloud – then you can deploy a hybrid solution, pushing the data back on premise. It’s in essence a mirror of the capabilities we’ve been providing to the Financial Services sector in the instant messaging and unified communications space since 2001.
So, with 95 features across Facebook, LinkedIn and Twitter, as well as archiving the content shared, SEEN and in context – as well as enabling content to be moderated prior to posting, – we think its a pretty comprehensive solution!
I show some of the capabilities every Tuesday at 9 pacific in a webinar for interested parties.

Sarah,
I think it is great to provide the industry with multiple deployment options, across hosted SaaS, onsite install and a hybrid model. Thanks for pointing out that this is a new option from Facetime. Have you seen a preferred deployment option emerge yet in Financial Services?
Thanks for the comment!
Adam
seeing on premise very much the choice of the larger organization. Although SaaS is starting to see take up – there are still concerns generally about “the cloud”

Hi Sarah,
I could see how there is some concern over securing proprietary compliance data in the cloud full-time. I am sure there is a way to replicate down to on-premise storage with a guaranteed delivery and delivery confirmation process. Seems that the speed to market of SaaS with a replicated option on-premise is a nice architectural solution.

Thanks so much for your coverage of social media solutions addressing the archiving and compliance needs for financial services. Our team at Arkovi spent two decades working in the independent financial services space prior to launching in 2009 – and like so many others see the power of integrating social media tools into business. A full list of individual and enterprise features in Arkovi can be found at http://www.arkovi.com/comparison.php
